Non-3M Workforce Working in U.S.



Applies To
All non-3M workers assigned to work at  3M in the U.S. requiring unescorted access to 3M facilities or access to 3M corporate systems.

Introduction
3M utilizes non-3M workers to meet business objectives.  In order to promote a productive and safe work environment and comply with various laws and regulations, 3M has established pre-assignment requirements for non-3M workers. References to Supplier and Seller have the same meaning.

Requirements & Policy Statements
Non-3M workers must meet defined pre-assignment requirements prior to the first day of assignment. Unless otherwise noted, the supplier is responsible for ensuring that non-3M workers meet these requirements, retain supporting documentation, and make supporting documentation and records available to 3M upon request for audit purposes.

What is the Non-3M Workforce Pre-Assignment Requirements Policy?

  1. It is a set of requirements that must be met prior to a non-3M worker being given:
    1. Unescorted building access (badge)
      or
    2. IT Security access (systems)
  2. It outlines 3M’s requirements to comply with laws and regulations and to promote a productive and safe work environment

Pre-Assignment Requirements:
Apply to all non-3M workers

Unique Identification Number
A unique identification number (i.e. social security number for U.S.) is necessary to protect 3M facilities and information contained in 3M systems. 3M Contacts and suppliers must ensure that a valid unique identification number is provided prior to the start of the assignment.

Confidentiality Agreement
Non-3M workers are required to protect 3M’s confidential and proprietary information and must be subject to a signed agreement containing confidentiality provisions.  The Seller Personnel Agreement (document available within Requirements Documents tab) is the preferred confidentiality agreement for most non-3M workers.  Given the diversity of agreements that already exist between suppliers, non-3M workers and 3M, it may be possible that the worker's confidentiality agreement obligation is addressed through another agreement already in place with 3M that includes confidentiality obligations.  These agreements may include a supplier agreement, a confidential disclosure agreement, or equivalent agreement. 3M employees assigning non-3M workers are responsible to ensure that an appropriate agreement is in place.

Privacy Notice and Consent
Suppliers of non-3M workers are required to review the Privacy Notice and Consent Regarding Personal Information Transfer and Storage form (document available within Requirements Documents tab) with the non-3M worker and obtain their signature prior to the start of an assignment at 3M. Note: Non-3M workers that have signed the current Seller Personnel Agreement are exempt.

Prohibited Parties List
Suppliers of non-3M workers are required to verify that the non-3M worker is not on the U.S. government’s “Prohibited Parties Lists,” which are: (a) the Commerce Department’s Entity List, Denied Persons List, and Unverified List; (b) Treasury Department Specially Designated Nationals & Blocked Persons List; and (c) State Department Debarred Parties List.


Additional Pre-Assignment Requirements:
Apply to all Non-3M Workers With Noted Exceptions

Verification of Work Authorization/3M Audit Rights
Suppliers of non-3M workers are responsible for verifying that non-3M workers have valid work authorization and for making supporting documentation and records available to 3M upon request for audit purposes. A third party supplier will verify work authorization for independent non-3M workers. Only non-3M workers with valid work authorization are eligible for assignment.

3M requires all suppliers to comply with applicable laws concerning work authorization. Suppliers may be exempt from detailed verification or audit requirements if placing non-3M workers in Delivery Driver or Third Party Contract Manufacturing assignments as access to 3M facilities or systems is limited.

Background Screening
Suppliers of non-3M workers are required to perform the background screening consistent with 3M's background screening requirements (details available within Requirements Documents tab). A third party supplier will perform this service for independent non-3M workers. Only non-3M workers who meet 3M's background screening requirements are eligible for assignment. A new background screening will be completed for non-3M workers with a lapse in assignment of greater than 6 months.

Non-3M workers in Delivery Driver and Third Party Contract Manufacturing assignments may be exempt if their access to 3M facilities or corporate systems is limited.

Drug Screening
Suppliers of non-3M workers will perform the drug screening per 3M;s drug screening requirements (details available within Requirements Documents tab). A third party supplier will perform this service for independent non-3M workers. Only non-3M workers who meet 3M's drug screening requirements are eligible for assignment. A new drug screening must be completed for non-3M workers with a lapse in assignment of greater than 6 months. A drug screen is required for on-site non-3M workers with a non-escort (i.e yellow) badge. Off-site non-3M workers who are granted systems access only are not required to complete a drug screening. Non-3M workers in Delivery Driver and Third Party Contract Manufacturing assignments may be exempt if their access to 3M facilities or corporate systems is limited.

Access Control
3M desires to provide a safe and secure work environment for all individuals who do business with 3M.  3M policy is to control physical access to all 3M facilities and to create and maintain records of individuals entering and exiting 3M facilities.

Suppliers of non-3M workers working at 3M are expected to review 3M’s Non-3M Workforce Access Control Policy (document available within Document Library tab).  with the non-3M worker and obtain their signature prior to the start of an assignment at 3M.

Former 3M Employees or Former Non-3M Workers
Former 3M employees or former non-3M workers may be ineligible for assignment.   The Non-3M Workforce Program team will verify eligibility for assignment. Non-3M workers in Delivery Driver and Third Party Contract Manufacturing assignments may be exempt if their access to 3M facilities or corporate systems is limited.

Former or Current Government Employee
Suppliers will comply with 3M’s process if a non-3M worker or an immediate family member (spouse, child, parent, brother or sister) currently or ever have been employed by a U.S. Federal, State, Local or Foreign Government (either as a civilian or in the military), or in a Reserve or Guard component of the Armed Services, or in any other position that may either: (1) prevent the non-3M worker from entering into a contract with 3M, or (2) place restrictions on what work assignments 3M may give the non-3M worker due to U.S. Federal, State, Local or Foreign Government "revolving door" or conflict of interest laws.

  • Suppliers will ask whether a non-3M worker is a former or current government employee
  • If non-3M worker indicates a positive response, Supplier will issue a Conflict of Interest Questionnaire (COI-1) (document available within Requirements Documents tab) to the non-3M worker and send the completed questionnaire to 3M for review.
  • Upon review, 3M will advise the supplier of any further requirements which may include a secondary questionnaire

A third party supplier will perform this service for independent non-3M workers.

Non-3M workers inDelivery Driver andThird Party Contract Manufacturing assignments may be exempt if their access to 3M facilities or corporate systems is limited.


Selective Pre-Assignment Requirements:
Apply to non-3M Workers Based on the Role Performed

Export Control
As a global company, 3M must comply with various export regulations, collectively known as export controls.  All 3M businesses must adhere to these regulations in order for 3M to sell or otherwise export from the U.S. certain products, technology, and equipment, as well as share certain export-controlled technology with "non-U.S. persons" within the United States. If an assignment is subject to export control requirements, suppliers of non-3M workers will comply with 3M’s export control process.

  • 3M will notify suppliers if the assignment is subject to the export control requirements and as such will require that the non-3M worker disclose their country of birth, current citizenship(s) and the order in which they were obtained, if more than one
  • Suppliers will provide birth country and citizenship information, and any requested supplemental information, to 3M in order for 3M to determine whether non-3M workers are eligible for an export controlled assignment.
  • Upon completion of the determination of eligibility for the export controlled assignment, 3M will notify the supplier or the independent worker of the determination and next steps.

A third party supplier will perform this service for independent non-3M workers.

3M Manufacturing Qualification Test
All non-3M workers in a manufacturing or warehouse assignment must meet requirements for the 3M Manufacturing Qualification Test to be eligible for assignment.  Suppliers of non-3M workers are required to administer this test to their non-3M workers and deliver the results to the 3M location’s HR Representative.  If a passing score is achieved, the worker is eligible for assignment.  If a passing score is not achieved, a six-month waiting period is required before the worker can re-take the test.

Medical Surveillance
Specific baseline medical surveillance exams may be required for non-3M workers in a manufacturing or warehouse role prior to assignment at a 3M facility.

3M will notify suppliers of non-3M workers that medical surveillance is needed and will provide the following information:

  • List of what medical surveillance programs are needed
  • Copy of medical surveillance protocols and test instructions if needed

Suppliers must provide all medical surveillance required by governmental agencies or 3M.  It is the responsibility of the suppliers to arrange for needed medical surveillance and to ensure the evaluations are completed. Once the exams are completed, suppliers must provide 3M location’s HR Representative with a Medical Surveillance Certificate for each non-3M worker.

Anti Bribery
Additional due diligence and 3M legal and/or business approvals are required if the non-3M assignment requires contact with any government official, sales to public entities (e.g. university hospitals), government inspectors, entities that are partially or wholly government-owned, international organizations (U.N., Red Cross), political parties/candidates, etc.  The non-3M worker will be required to review and sign the Non-3M Workforce Anti-Bribery Policy (document available within Requirements Documents tab). 3M Contacts and suppliers are responsible for ensuring that this requirement is met prior to the start of assignment.

Food and Drug Administration
If an assignment is subject to Food and Drug Administration (FDA) requirements, suppliers of non-3M workers must verify that the worker is not on the FDA Debarment List.  Non-3M workers listed on the FDA Debarment List are ineligible for assignments subject to FDA requirements.

A third party supplier will perform this service for independent non-3M workers.

Occupational Safety and Health Administration (OSHA)
Additional location specific OSHA pre-assignment requirements may be required.  Please contact your 3M location’s HR Representative for applicable location specific pre-assignment requirements.

Mine Safety and Health Administration (MSHA)
Additional location specific MSHA pre-assignment requirements may be required.  Please contact your 3M location’s HR Representative for applicable location specific pre-assignment requirements.
