Linux TouchWare Drivers

The TouchWare 5.64 SR1 for Linux driver provides support for 3M Touch Systems touch screens on Linux Kernel 2.4 and 2.6 operating systems. This release of software operates with EX II, SC series, SMT3, and MTx Serial and USB touch screen controllers.

The following Xfree86 versions are supported: 4.0.3, 4.1.0, 4.2.0, and 4.3.0.

The TouchWare 5.64 SR1 for Linux is in the form of Source RPM and requires additional steps from the user to build a binary package compatible with their system.

PLEASE READ THIS LICENSE CAREFULLY BEFORE CONTINUING. BY DOWNLOADING OR INSTALLING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, CLICK "I DECLINE" AT THE END OF THIS AGREEMENT TO DISCONTINUE THE DOWNLOAD/INSTALLATION.

Recitals

WHEREAS, 3M Touch Systems has designed and developed driver software TouchWare for Linux Source and Object kit, for use with touch-sensitive input systems that include 3M Touch Systems touch sensors and controllers; and

WHEREAS, Licensee intends to embed the 3M Touch Systems driver software in a computer system that includes other hardware and software, thereby creating an integrated system that is capable of incorporating a touch-sensitive input system; and

WHEREAS, 3M Touch Systems is willing to allow Licensee access to the TouchWare for Linux Source and Object kit for the sole purposes of copying and translating it into object code for embedding into the computer systems for distribution; and

WHEREAS, Licensee desires to license the TouchWare for Linux Source and Object kit in order to embed the software in its products to be distributed to end-users, either directly or through a distributor, the end-users intending to use the software as integrated by Licensee for internal use only and not for sublicense or further distribution;

THEREFORE, in consideration of the mutual covenants contained herein and intending to be legally bound, the parties hereby agree as follows:

1.0 Definitions.
1.1 The term, "Derivative Work" means any work that is based upon one or more pre-existing works, such as a revision, modification, translation, abridgment, condensation, expansion or any other form in which such pre-existing work may be recast, transformed or adapted and that if prepared without the authorization of the owner of the pre-existing work would constitute copyright infringement or other violation of the proprietary rights of the owner.
1.2 The term, "Licensed Software" means the TouchWare for Linux Source and Object kit and any Derivative Works thereof, in Source Code and Object Code form.
1.3 The term "Modified Code" shall mean a Derivative Work of the Licensed Software made by Licensee, in Source Code and Object Code form.
1.4 The term, "Licensee Product" means a computer system that includes an embedded copy of the Licensed Software and/or Modified Code along with other equipment or computer software independently developed or procured by Licensee or Licensee's distributor, the computer system capable of incorporating a 3M Touch Systems touch screen and controller that can communicate with the computer system using the embedded Licensed Software and/or Modified Code.
1.5 The term, "Documentation" means those written materials issued by 3M Touch Systems in conjunction with the Licensed Software.
1.6 The term, "Object Code" means a copy of the Licensed Software and/or Modified Code, or portions thereof, which has been converted or translated into the machine language of the computer with which it is intended to be used.
1.7 The term "Source Code" means a copy of the Licensed Software and/or Modified Code, or portions thereof, in human readable format, including all internal documentation.
2.0 License Grant.
2.1 3M Touch Systems grants Licensee a non-exclusive, limited license to copy, make Derivative Works of, translate into Object Code, and to embed into and distribute as part of Licensee Products, the Licensed Software and any Modified Code. Except as specifically provided herein, Licensee may not pledge, assign, license, lease, time share or otherwise transfer, in whole or in part, the Licensed Software or Modified Code without the prior written consent of 3M Touch Systems.
2.2 3M Touch Systems grants Licensee the right to grant others the right to distribute the Licensed Software or Modified Code as part of Licensee Products only. Licensee shall not sublicense any other rights granted to it under this Agreement.
2.3 All copies of the Licensed Software, Modified Code, or any portion thereof made or distributed by Licensee shall be marked with 3M Touch Systems' copyright, trademark and other proprietary rights notices as they appear on the original as provided to Licensee by 3M Touch Systems.
2.4 3M Touch Systems reserves the right to market, sell, distribute, license and sublicense the Licensed Software directly to end-users, or indirectly through other distributors, systems integrators, or in any manner whatsoever.
3.0 Ownership.
3.1 Licensee acknowledges that the Licensed Software and any modifications, enhancements, translations or Derivative Works thereof, are the property and proprietary information of 3M Touch Systems and that this Agreement grants Licensee no title or ownership right in the Licensed Software.
3.2 If, notwithstanding the provisions of Section 3.1 herein, ownership of all right, title and interest in and to any modifications, enhancements, translations or Derivative Works of the Licensed Software, Documentation or any portion thereof shall not be deemed to vest exclusively in 3M Touch Systems, then Licensee, without further consideration, agrees to assign and, upon the creation thereof, automatically assigns to 3M Touch Systems all right, title and interest to any such modifications, enhancements, translations or Derivative Works, and 3M Touch Systems shall have the right to register evidence of such ownership exclusively in its own name.
4.0 Disclaimer of Warranties.
4.1 LICENSEE ACCEPTS THE LICENSED SOFTWARE "AS IS" AND "WITH ALL FAULTS". THE LICENSED SOFTWARE IS PROVIDED WITHOUT ANY WARRANTY WHATSOEVER. 3M TOUCH SYSTEMS DISCLAIMS ALL WARRANTIES, WHETHER STATUTORY, EXPRESS, IMPLIED, ORAL OR WRITTEN, INCLUDING ALL WARRANTIES OF NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE SELECTION, DISTRIBUTION AND USE OF THE LICENSED SOFTWARE IS WITH LICENSEE. 3M TOUCH SYSTEMS DOES NOT WARRANT THAT THE LICENSED SOFTWARE WILL MEET THE REQUIREMENTS OF LICENSEE OR ANY END-USER OR THAT THE OPERATION OF THE LICENSED SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE.
4.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL 3M TOUCH SYSTEMS BE LIABLE TO LICENSEE, ANY END-USER OR ANY THIRD PARTY FOR DIRECT, SPECIAL, INCIDENTAL, INDIRECT, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, GOODWILL OR SAVINGS, DOWNTIME, DAMAGE TO OR REPLACEMENT OF PROGRAMS AND DATA) OR OTHER ECONOMIC HARDSHIP ARISING FROM THE USE OR INABILITY TO USE THE LICENSED SOFTWARE BY LICENSEE, ANY END-USER OR ANY THIRD PARTY OR FROM CLAIMS BASED IN WARRANTY, CONTRACT, TORT, (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF 3M TOUCH SYSTEMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH CLAIM OR DAMAGE.
5.0 Indemnification.
5.1 Licensee shall indemnify and hold 3M Touch Systems harmless from any and all claims, actions, suits, costs, damages, losses, expenses, and liabilities, including attorneys' fees, arising out of Licensee's possession, use, demonstration or distribution of the Licensed Software or Modified Code including, without limitation, any guarantee, representation or warranty, express or implied, made or given by Licensee and any Licensed Software modification or combination of the Licensed Software with any item not supplied by 3M Touch Systems.
5.2 3M Touch Systems shall defend, or at its option, settle any claims brought against Licensee to the extent based upon a claim that the Licensed Software as unmodified by Licensee infringes any patent, copyright, trade secret or other proprietary right, and 3M Touch Systems agrees to pay any settlement amounts or damages, including attorney's fees, awarded against Licensee to the extent based upon such a claim. Notwithstanding the foregoing, however, Licensee agrees that 3M Touch Systems shall be relieved of its obligations under Section 8.2 unless Licensee (i) promptly notifies 3M Touch Systems in writing of such a claim; (ii) gives 3M Touch Systems full control of the defense and/or settlement of such a claim; and (iii) provides reasonable assistance and full information to settle or defend such a claim.
5.3 If the Licensed Software, or any part thereof, is, or in the opinion of 3M Touch Systems may become, the subject of any claim for infringement of any third party patent or copyright, or if it is adjudicatively determined that the Licensed Software, or any part thereof infringes any third party patent or copyright, then 3M Touch Systems may, at its sole discretion, (i) suitably modify the Licensed Software or (ii) provide a suitable substitute for the Licensed Software.
5.4 SECTIONS 5.2 AND 5.3 STATE 3M TOUCH SYSTEMS'S ENTIRE LIABILITY AND OBLIGATION TO LICENSEE WITH RESPECT TO ANY ALLEGED INFRINGEMENT OF PATENTS, COPYRIGHTS, TRADEMARKS, TRADE SECRETS OR ANY OTHER INTELLECTUAL PROPERTY RIGHTS BY THE LICENSED SOFTWARE OR DOCUMENTATION.
6.0 Changes/Availability of Licensed Software.
6.1 3M Touch Systems reserves the right at any time to effect changes in or to discontinue the sale or license of the Licensed Software or any portion thereof without incurring any liability to Licensee.
7.0 Export.
7.1 Licensee represents, warrants and agrees that the Licensed Software and any Modified Code will not be shipped, transferred or exported into any other country or used in any manner prohibited by the United States Export Administration Act or any other export laws, restrictions, or regulations.
7.2 U.S. Government End Users. The Licensed Software and Documentation are considered "Commercial Items," as defined in 48 C.F.R. 2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as defined in 48 C.F.R. 12.212 or 48 C.F.R. 227.7202, as applicable. The Licensed Software and Documentation are being licensed to U.S. Government end users (i) only as Commercial Items, and (ii) with only those rights granted to all other end users pursuant to this Agreement.
8.0 Termination.
8.1 3M Touch Systems may terminate this Agreement without cause and without liability at any time upon not less than thirty (30) days' prior written notice to Licensee.
8.2 Except as expressly provided herein, neither 3M Touch Systems nor Licensee shall be liable to the other, or to any other party, by virtue of the termination or expiration of this Agreement for any reason whatsoever, including, but not limited to, any claim for loss of profits or prospective profits or for anticipated sales of Licensed Software.
9.0 General.
9.1 If any portion of this Agreement is held invalid, the parties agree that such invalidity shall not affect the validity of the remaining portions of this Agreement, and the parties further agree to substitute for the invalid provision a valid provision that most closely approximates the economic effect and intent of the invalid provision.
9.2 The validity of this Agreement and the rights, obligations and relations of the parties hereunder shall be determined under the substantive laws of the Commonwealth of Massachusetts without regard to principles governing choice of law. The parties hereby acknowledge and agree that the U.N. Convention on Contracts for the International Sale of Goods shall not apply to this Agreement. Exclusive jurisdiction and venue for all purposes hereunder shall be in Boston, Massachusetts, and the parties hereto hereby consent to such jurisdiction and venue.
9.3 This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersede all proposals, oral or written, all previous negotiations and all previous communications between the parties with respect thereto.

3M Touch Systems does provide build packages for some of the most common distributions.

The Binary RPMs below are created only for specific kernel/distribution combinations.

For all other kernel versions, use the Source RPM above.

PLEASE READ THIS LICENSE CAREFULLY BEFORE CONTINUING. BY DOWNLOADING OR INSTALLING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, CLICK "I do not accept" AT THE END OF THIS AGREEMENT TO DISCONTINUE THE DOWNLOAD/INSTALLATION.

1. License. The MicroTouch™ software you are downloading/installing from 3M Touch Systems ("Software") is licensed to you by 3M Touch Systems, and 3M Touch Systems retains title to the Software. This Software has been designed specifically for use with 3M Touch Systems' touch sensors and controllers. This License allows you to install and use the Software on any PC for use with a 3M Touch Systems product (a "Touch Screen Product") comprised of at least a 3M Touch Systems controller in combination with a 3M Touch Systems touch sensor. You may also make one back-up copy of the Software. In the event that the PC is not on a network or does not have a CD drive, then you may make a single copy of the Software onto floppy disc in order to load the Software onto the PC.

2. Restrictions. The Software contains copyrighted material, trade secrets and other proprietary material. To protect them, you may not decompile, reverse engineer, disassemble or otherwise reduce the Software to human-perceivable form, except in the limited circumstances permitted by law, and you agree to include in any back-up copy of the Software that you make such copyright or other proprietary rights notices as are included with the Software as provided to you. You may not modify or create derivative works based on the Software, in whole or in part. You may not transfer your rights in the Software, except that you may transfer the Software (including any back-up copy) together with the Touch Screen Product with which it is used to a transferee that agrees to comply with the terms of this License. In such event, you may not keep any copy of the Software.

3. Documentation. 3M Touch Systems also authorizes you to download individual copies of the appropriate documentation ("Documentation") provided by 3M Touch Systems for use with the Software. You will own the downloaded copy(ies) of the Documentation, and may make copies solely for your internal use provided the copies include the copyright notice, but you may not create derivative works of the Documentation, in whole or in part.

4. Termination. This License is effective until terminated. You may terminate this License at any time by destroying all copies of the Software then in your possession or control. This License will terminate immediately without notice from 3M Touch Systems if you fail to comply with any of its provisions. Upon termination, you must destroy all copies of the Software then in your possession or control.

5. Export Law Assurance. You represent, warrant and agree that the Software will not be shipped, transferred or exported into any other country or used in any manner prohibited by the United States Export Administration Act or any other export laws, restrictions, or regulations.

6. Warranty. 3M Touch Systems warrants that for a period of 90 days from the date of receipt, the Software will materially conform to 3M Touch Systems' then-current published specifications for the most current version of such Software when used as instructed. 3M Touch Systems does not warrant the Software is free from all bugs, errors or omissions. The cost of setup and evaluation of the Software shall be borne by you.

THE ABOVE WARRANTIES EXTEND ONLY TO THE INITIAL LICENSEE OF THE SOFTWARE AND ARE NON-TRANSFERABLE. 3M TOUCH SYSTEMS DISCLAIMS ALL OTHER WARRANTIES RELATING TO THE SOFTWARE OR DOCUMENTATION, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND TITLE AND THOSE ARISING FROM TRADE USAGE OR COURSE OF DEALING.

If the Software is found to be defective within the warranty period, then your exclusive remedy and 3M Touch Systems' sole obligation is to replace or correct the Software, or refund the purchase price, at 3M Touch Systems' option.

7. Limitation of Liability. Except for personal injury, 3M Touch Systems shall not be liable for direct, indirect, special, incidental or consequential damages based upon breach of warranty, breach of contract, negligence, strict liability or any other legal theory.

8. U.S. Government End Users. The Software and Documentation are considered "Commercial Items," as defined in 48 C.F.R. 2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as defined in 48 C.F.R. 12.212 or 48 C.F.R. 227.7202, as applicable. The Software and Documentation are being licensed to U.S. Government end users (i) only as Commercial Items, and (ii) with only those rights granted to all other end users pursuant to this Agreement.

9. Controlling Law and Severability. This License shall be governed by and construed in accordance with the laws of the United States and the State of Minnesota, as applied to agreements entered into and to be performed entirely within Minnesota between Minnesota residents. If for any reason a court of competent jurisdiction finds any provision of this License, or portions thereof, to be unenforceable, that provision of the License shall be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this License shall continue in full force and effect.

10. Complete Agreement. This License constitutes the entire agreement between the parties with respect to the use of the Software and Documentation. No amendment to or modification of this License will be binding unless in writing and signed by a duly authorized representative of 3M Touch Systems.

MicroTouch™ Software HID Calibration Tool is a new member of the MicroTouch Software Suite. The HID Calibration Tool provides support for MicroTouch touch screen operation on the Microsoft® Windows® 98SE, Me, 2000, XP operating systems. This tool works with MicroTouch controllers that support HID including the new SC Series USB HID compatible 4-, 5-, 8-wire resistive controllers. Use this calibration tool for optimization of touch performance to the MicroTouch™ touch screen 1% TPE accuracy specification.

Microcal is compatible with fully-integrated ClearTek capacitive and TouchTek resistive touch screens. This service release includes maintenance updates to the USB and PS/2 drivers to be compatible with Windows XP SP2. Supported platforms include: Windows XP, Windows 2000, Windows NT, Windows 9x, and windows ME.

Note: new SC Series controller support limited to serial interface only

This release provides improved overall performance and more robust features for all supported platforms. Supported platforms are Win2000/WinNT/Win9x/Me.

TouchWare 5.61SR1 for WinCE.NET 4.x. supports Serial (RS-232) SMT3, EX II, and MTx controllers on the x86 platform only. This software driver (sourceless) is provided for integration into a Microsoft Windows WinCE.NET 4.x system build.

This driver is designed for MicroTouch USB ClearTek 3000 and TouchTek controllers. The operating systems supported are Mac OS 8.5, 8.5.1, 8.6, and 9.0 on iMac, G3 and G4 systems with USB firmware 1.1 or 1.2. The following options are accessed through the control panel: calibration, configuration options and multiple monitors support for up to 4 USB touch screens. The installation is manual. You can download the following file TW532Mac.sit. To extract it you will need a third party software called StuffIt Expander available from http://www.aladdinsys.com/expander/index.html.
